Good morning!
Yesterday we appealed the refusal of
our request for permission for judicial review of Natural England's
licensing of free-shooting of badgers. Unfortunately, despite the
brilliance of our barrister David Wolfe QC, we lost. However, we have
decided to go for another appeal and so the case lives on.
Why keep going? The legal arguments
are becoming clearer as they are scrutinised and we believe that
building on progress made yesterday, with another judge, we stand a good
chance of success (though these things are difficult to assess). In any
case, a future successful appeal has no overall financial cost compared
with a successful appeal yesterday and only a very small financial cost
compared with throwing in the towel now. We believe that you, our
supporters, would wish us to see this through while there is a decent
chance of success which will ease the plight of Badgers in our
countryside.
A further appeal with take several weeks ...
... by which time we may have been in
court (virtually, online) in our gamebirds challenge. Yesterday there
were developments in that case and as the hearing, 3 and 4 November,
approaches there are legal papers going backwards and forwards. We
believe we have very strong arguments in this case and are looking
forward to them being tested in court.
In other news:
COVID-19 has slowed down some of our
projects, one of which is to send out free books on the issue of
wildlife crime to public libraries and schools. Thanks to the generosity
of the publishers (Oxford University Press, Bloomsbury and Barrington
Stoke), the authors (Gill Lewis for Eagle Warrior and Skydancer, and our own Mark Avery for Inglorious) and to Henry Morris's donation last
year, we are sending several hundred books out now. We'll give a slightly more detailed summary in a future newsletter.
Our own Chris Packham and Megan McGubbin are nominated in the annual Birdwatch magazine's
Birders' Choice awards, as is the Save our Skydancers e-action that
resulted in 120,000+ messages being sent to politicians. You don't have
